Growth Impacts Disclosure Ordinance


The {City/County/ District} of ________ ordains:

The {Council/Commission/Board} finds:

    1. The construction of new homes and other buildings in our community creates a need for new infrastructure and public services.
    2. The infrastructure and services needed to serve new construction includes roads, water lines, sewers, parks, police and fire stations, school buildings and other publicly provided capital improvements.
    3. Governor Kitzhaber's Task Force on Growth in Oregon reported that the construction costs of facilities to serve each new single family house are $30,000 to $50,000.
    4. It is fair that those who profit from the construction of new houses and buildings should pay those costs instead of taxpayers and ratepayers.
    5. Only a portion of those costs are now paid, in the form of systems development charges, by the developers of new buildings in many communities including ours.
    6. Oregon Revised Statutes sections 223.297 to 223.313 authorize local government units to charge developers a greater percentage of the costs of growth than is now imposed by this {city/county/district}.
    7. Affordable housing should be {fully or partially} exempt from systems development charges.
    8. It is in the best interests of the citizens of this community that growth pay its own way.
    9. The systems development charges paid by developers in this community, except for development of affordable housing, should be the maximum amounts authorized by state law.

NOW, THEREFORE, the {Council/Board/Commission} directs:

    1. That the systems development charges imposed by this {City/County/District} shall in all instances be the maximum amounts allowed by the law of Oregon.
    2. That the only exception shall be that affordable housing shall be {fully/partially to the extent of ____ } exempt from systems development charges. As used in this ordinance, "affordable housing" shall be defined as in state law related to systems development charges, or if not defined therein, shall be defined to mean housing built for individuals with incomes that are equal to or less than 80 percent of the median income in this county and for which payments do not exceed 30 percent of the monthly income of the individuals occupying the housing.
    3. The {bureau/department/agency of ______} is hereby directed to study the current systems development charges imposed by this {city/county/district} and report to the {Council/Commission/Board} by _______ on the increases necessary to impose the full amounts of systems development charges authorized by state law.
